Mobile Terms of Service

Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice.

If we make material changes to these Mobile Terms, we will post the updated version on our website and, where required by law, notify you by text message. Your continued use after the effective date of such changes constitutes your acceptance of the revised terms.

1. Consent to Receive Messages
By opting in and providing your express written consent, you agree to receive recurring SMS/text messages from and on behalf of Easy Breathe through your wireless provider to the mobile number you provided, even if your number is on a state or federal Do Not Call list. Your consent is not a condition of purchase.

Messages may be sent using an automatic telephone dialing system (ATDS) or similar automated technology. Service-related messages include updates, alerts, and account notices; promotional messages may include discounts, reminders, or special offers.

By opting in, you certify that you are the owner or authorized user of the number provided and are at least 18 years old (or the age of majority in your jurisdiction).

2. Voluntary Participation
Your participation is voluntary, and your consent is not required to make any purchase from Easy Breathe.

3. Message Frequency and Hours
We do not charge for the Service, but your carrier’s message and data rates may apply. We will send no more than six (6) messages per week and no more than three (3) per 24-hour period.

We send marketing texts only between 8 a.m. and 9 p.m. (recipient’s local time) in compliance with federal TCPA and state mini-TCPA rules.

Check your mobile plan and contact your carrier for details.

4. Identification of Sender
Each message will clearly identify “Easy Breathe” as the sender and include a valid return text option, toll-free number, or email address as required by applicable law.

5. Opt-Out and Support
Text STOP to +1 (855) 616-0334 or click the unsubscribe link (where available) to cancel. You’ll receive one confirmation text, and no further marketing messages will be sent unless you re-subscribe.

6. Changes to Program Numbers
We may change the number or short code used for this Service. We will notify you of any number changes, and messages sent to a retired number may not be received.

7. Compliance with Federal and State Laws
We comply with the federal Telephone Consumer Protection Act (TCPA) and all applicable state “mini-TCPA” laws. These laws may restrict the hours during which texts may be sent, limit message frequency, and require inclusion of a callback number or live agent option.

Easy Breathe monitors and updates its messaging practices to remain compliant with state-specific requirements, including the Florida, Oklahoma, Washington, and Maryland mini-TCPA statutes.

8. Limitation of Liability
Carriers are not liable for delayed or undelivered messages. If you change your mobile number, you must re-subscribe.

To the extent permitted by law, Easy Breathe is not liable for failed, delayed, or misdirected messages or actions you take in reliance on them. This limitation does not apply to violations of federal or state telemarketing laws.

9. Privacy
We respect your privacy. See our Privacy Policy.

We retain records of your opt-in, consent language, timestamps, and opt-outs to demonstrate compliance with TCPA and state mini-TCPA requirements.

10. Separate Programs
If you subscribe to more than one Easy Breathe SMS program, you must opt in and opt out separately for each program, unless state law requires otherwise.

11. Governing Law
These Mobile Terms are governed by federal law and the laws of your state of residence, including any applicable mini-TCPA statutes.
